Workers’ Compensation:
Workers’ compensation is a type of insurance that provides benefits for employees who sustain injuries as a direct result of their job activities. The goal of workers’ compensation insurance is to help protect the health and income of injured workers.

Any employee that has been injured while performing assigned duties during assigned work hours has a legal right to file a workers’ compensation claim. In the event that an employee should die as a result of a work-related injury, the employee’s dependants may also be eligible for monetary benefits.

In general, you will be covered under Georgia Workers’ Compensation law if your employer has three or more employees, and you were injured performing work that arose out of or in the course of your employment. However, the system is complex, and obtaining benefits from your employer can often be challenging in regards to receipt of your maximum entitlement.

Social Security Disability (SSDI/SSI):
The Social Security Administration provides benefits (SSDI) for individuals who are unable to work for 12 consecutive months due to an injury or illness. The Social Security Administration also offers benefits (SSI) for individuals who are unable to provide for themselves or their family because of an illness or injury although they have never worked or paid Social Security taxes.

BUT, Social Security law is complex. Unfortunately, legitimate requests for disability benefits are routinely denied by the Social Security Administration, and the process to obtain benefits can be lengthy, requiring representation from an experienced attorney. Childhood Disability

Similar to the process by which SSA determines disability for an adult, the SSA provides a strict definition of disability to determine eligibility for children. In addition to your child undergoing a disability interview, you as the caregiver must provide an extensive amount of documentation to support the claim.  Even if your child has a successful claim, once your child reaches the age of 18, he or she will be reevaluated by the Administration for continuing disability benefits under the adult standard.
